Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Fernando Tang ("we", "us"), governing your use of the sharedBeat mobile application and related services (the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.


1. Eligibility

You must be at least 18 years old to use sharedBeat. By using the App you represent that you are 18 or older and able to enter into this agreement.

2. Your account

You sign in using a supported provider (e.g. Google or Apple). You are responsible for keeping access to your account secure and for activity under your account. Notify us at support@sharedbeat.app of any unauthorised use.

3. The service

sharedBeat lets you set personal goals, log check-ins (including photos), join groups and "seasons", react to others' check-ins, and view leaderboards. Some features use AI to suggest goals and generate recap text (see §7). We may add, change, or remove features over time. The App is currently provided free of charge; we may introduce paid features in the future, in which case additional terms and pricing will be presented before purchase.

4. Your content

You retain ownership of the content you create (goals, text, photos — "Your Content"). By posting Your Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display it solely to operate and provide the App (e.g. showing your check-ins to members of your groups). This licence ends when you delete the content or your account, except for copies in routine backups that expire on our normal schedule.

You are responsible for Your Content. You must have the right to post it, and it must comply with our Acceptable Use Policy. Do not post photos of other people without their consent.

5. Acceptable use

You agree not to misuse the App. Prohibited conduct is described in our Acceptable Use Policy, which is incorporated into these Terms. We may remove content and suspend or terminate accounts that violate it. Other users can report content and block users from within the App; we aim to review valid reports promptly (typically within 24 hours).

6. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we handle your personal data.

7. AI features

The App uses third-party AI to generate suggestions and text. AI output is automatically generated, may be inaccurate or inappropriate, and is not professional, medical, financial, or legal advice. You use AI suggestions at your own discretion. See our AI Transparency Notice.

8. Intellectual property

The App, including its software, design, and trademarks, is owned by us or our licensors. We grant you a limited, personal, non-transferable, revocable licence to use the App in accordance with these Terms and the EULA.

9. Third-party services

The App relies on third-party services (e.g. Apple, Google, Supabase, Groq). Your use may be subject to their terms. We are not responsible for third-party services.

10. Termination

You may stop using the App and delete your account at any time (Settings → Delete account). We may suspend or terminate your access if you breach these Terms or to protect the service or other users. Provisions that by their nature should survive termination (e.g. ownership, disclaimers, limitations of liability) will survive.

11. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that AI outputs will be accurate. Nothing in these Terms limits rights you have as a consumer under mandatory Spanish/EU law.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or loss of data or profits. Nothing excludes liability that cannot be excluded by law (including for death, personal injury caused by negligence, fraud, or mandatory consumer rights). Where liability cannot be excluded, it is limited to the greatest extent permitted by law.

13. Governing law & disputes

These Terms are governed by the laws of Spain. If you are a consumer, you benefit from the mandatory protections of the law of your country of residence, and disputes may be brought before the competent courts of your domicile. EU consumers may also use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).

14. Changes

We may update these Terms. Material changes will be notified in-app or by email and take effect on the date stated. Continued use after changes means you accept them.
