This EULA governs your use of the sharedBeat application software (the "Licensed Application") provided by Fernando Tang ("Licensor"). It supplements our Terms of Service.
Note for Apple: Where we do not provide a custom EULA, the standard Apple Licensed Application End User License Agreement applies to downloads from the App Store. This document adds App-specific terms (UGC, AI).
1. Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Licensed Application on devices you own or control, for your personal, non-commercial use, subject to the Terms of Service and the rules of the app store you downloaded it from.
2. Restrictions
You may not: copy (except as permitted), modify, reverse-engineer, decompile, or create derivative works of the Licensed Application; rent, lease, lend, sell, or sublicense it; remove proprietary notices; or use it unlawfully or in violation of our Acceptable Use Policy.
3. User-generated content
The Licensed Application lets you create and share content. You are solely responsible for your content and must comply with the Acceptable Use Policy. We may remove content and act on reports as described there.
4. AI functionality
The Licensed Application includes AI-generated suggestions and text, which may be inaccurate and are not professional advice. See the AI Transparency Notice.
5. Maintenance & support
Support is provided by us (not the app store) at support@sharedbeat.app. The app store has no obligation to furnish maintenance or support.
6. Warranty & liability
The Licensed Application is provided "as is". To the maximum extent permitted by law, we disclaim warranties and limit liability as set out in the Terms of Service. Your mandatory consumer rights are unaffected.
7. Third-party beneficiary (Apple)
If you downloaded from the App Store, Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you. Any product claims, legal compliance, or intellectual-property claims relating to the Licensed Application are our responsibility, not Apple's.
8. Termination
This licence terminates automatically if you breach it or delete the App/your account.
9. Governing law
The Terms of Service governing-law and disputes provisions apply.
